Preamble

These General Terms and Conditions of Sale (hereinafter "General Terms and Conditions of Sale" or "GTC"), accessible on the www.rampal-latour.fr website (hereinafter "Site"), govern, without restriction or reservation, the entire relations between any natural person of at least 18 years of age acting for purposes that do not fall within the scope of his commercial, industrial, craft, liberal or agricultural activity (hereinafter the "Customer") who wishes to purchase the products for sale on the Site and the company RAMPAL PATOU, SARL with a capital of euros 1,500,000, registered with the Trade and Companies Register of Salon de Provence under number 453 810 756, having for intra-community VAT number FR32453810756 and for IDU number the FR211396_01EHTN, located at 201 Impasse Gaspard Monge - 13300 Salon de Provence, Tel: 09.70.71.60.94; Fax: 04.90.56.52.18, e-mail: serviceclients@rampal-latour.fr (hereinafter "RAMPAL LATOUR"). 

The main purpose of these GTC is to govern the conditions of sale of the products offered for sale by RAMPAL LATOUR (hereinafter "Product(s)") and ordered from RAMPAL LATOUR via the Site.

They may be printed and kept by the Customer. Consequently, any order from a Customer of a Product offered for sale on the www.rampal-latour.fr Site implies full acceptance of these General Terms and Conditions of Sale. Customer acknowledges that he read these GTC prior to his order.

You may register free of charge on the list of opposition to telephone canvassing BLOCTEL (www.bloctel.gouv.fr) in order to no longer be approached by telephone by a professional with whom you do not have a contractual relationship in progress, in accordance with the French Law No. 2014-344 of 17 March 2014.

1. User obligations

Any order via this internet Site implies the immediate and unreserved acceptance of these General Terms and Conditions of Sale, as well as the pricing conditions that form an integral part thereof. When you place your order by clicking on the "confirm" button, you declare to accept them.

These General Terms and Conditions of Sale detail the rights and obligations of Rampal Latour and its Customers; they apply, without restriction or reservation, to all sales of Products offered for sale by Rampal Latour and concluded only on the www.rampal-latour.com Site. This offer is reserved for adults and individuals with the necessary legal capacity to contract, that is to say natural persons not acting in any case in a professional capacity.

RAMPAL LATOUR advises the Customer to read the GTC with each new order, the latest version of the said General Terms and Conditions of Sale applying to any new order of Products. 

The Customer is invited to carefully read, download, print these GTC and to keep a copy.

2. Customer

Rampal Latour offers the sale of its Products on the Internet Site www.rampal-latour.com to consumer Customers with the necessary legal capacity to place an order. Rampal Latour cannot be required to verify the legal capacity of each Client.

Thus, any Customer guarantees to have the quality of consumer as defined by French law and jurisprudence. As such, it is expressly provided that the Customer acts outside any usual or commercial activity.

3. Products

3.1. Characteristics of the products

The Products sold by RAMPAL LATOUR on the Site comply with the European and French regulations in force. The Products are described as precisely as possible on the media made available to Customers.

The Customer undertakes to read this information carefully before placing an order on the Site.

The photographs used to present the Products have no contractual value.

The Products offered for sale on the present Internet site at the address www.rampal-latour.fr constitute the offer of Rampal Latour. Rampal Latour reserves the right to modify its collection at any time and to change the list and ranges of Products.

Rampal Latour reminds its Customers that Rampal Latour Products must be stored away from humidity, too high temperature or intense light and may be subject to an expiry date.

3.2. Ordering procedure

After having read all the essential characteristics of the Products marketed by RAMPAL LATOUR and these GTC, the Customer is invited to: select and specify the Product(s) he intends to order (reference number, color, etc.), as well as the terms of delivery of the Product(s) (deadlines, mode, price, etc.) among the proposed options; fill all information useful for the execution of his order (contact details, delivery address ...); and then pay its order using one of the proposed means of payment. During the same purchase, the Customer is limited to a maximum of 6 items for the same reference. For Products for which options are available, these specific references appear when the correct options have been selected.

A confirmation message summarizing the essential characteristics of his order and containing (or allowing him to download or print) the GTC is then sent to him (failing this, the Customer is invited to contact RAMPAL LATOUR's customer service).

RAMPAL LATOUR reserves the right to refuse any order provided it justifies legitimate reasons, in particular when the quantities purchased are abnormally high for a consumer or in the event of a dispute concerning the payment of an order.

3.3. Invoicing

During the ordering process, the Customer must enter the information necessary for invoicing (the sign (*) will indicate the mandatory fields that must be filled in for the Customer's order to be processed by RAMPAL LATOUR).

The Customer must also clearly specify all the information relating to the delivery, in particular the exact delivery address as well as any access code to this address.

The Customer must also specify the chosen means of payment.

Neither the purchase order that the Customer establishes online, nor the acknowledgment of receipt of the order that the Seller sends to the Customer by email constitute an invoice. Regardless of the method of order or payment used, the Customer will receive the original invoice upon delivery of the Products, inside the package.

3.4. Date of the order

The date of the order is the date on which RAMPAL LATOUR acknowledges receipt of the order online. The deadlines indicated on the Site only begin to run from this date.

4. Prices

For all Products, prices displayed on the Site are in euros all taxes included.

These prices do not include shipping costs, invoiced in addition to the price of the Products purchased according to the terms defined below and as indicated to the Customer before the validation of the order. Prices include the VAT applicable on the day of the order.

The sale price of the Products displayed in euros is the price in force at the time of placing the order.

The offers presented by Rampal Latour are valid as long as they are announced on the Site. Rampal Latour reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the Customer.

RAMPAL LATOUR is likely to organize various promotional operations, in particular in the form of announcements of price reductions or price comparison. The reference price used by RAMPAL LATOUR will be specified in the announcement.

The prices indicated are valid except there is a gross error. 

5. Product availability

RAMPAL LATOUR undertakes to deliver the Product on the date or within the period indicated to the Customer unless the Parties have agreed otherwise.

The unavailability of a Product is indicated on the Site, on the description sheet of the concerned Product. Customers may also be informed of the restocking of a Product by RAMPAL LATOUR.

In any case, if the unavailability has not been indicated at the time of the order, RAMPAL LATOUR undertakes to inform the Customer by email without delay if the Product is eventually unavailable.

In the event that a Product is unavailable, RAMPAL LATOUR may offer an alternative Product of equivalent quality and price.

If the Customer decides to cancel his order of unavailable Products, he will obtain a refund of all sums paid for the unavailable Products no later than thirty (30) days of payment.

6. Online reviews

Any Customer has the possibility to leave an online review or comment on the Products on the Site.

Within 14 days of purchasing Products on the Site, the Customer will receive an email from RAMPAL LATOUR to express his purchasing experience.

This review will be published and accessible on the home page of the Site.

As part of the dissemination of online reviews carried out on the Site, RAMPAL LATOUR hereby expressly undertakes to provide users with fair, clear and transparent information on the methods of publication and processing of reviews posted online. As such, RAMPAL LATOUR undertakes in particular to display the date of the review and any updates.

As such, it is specified that RAMPAL LATOUR moderates the opinions under the following conditions:

In case of control exercised on the opinions, RAMPAL LATOUR undertakes to ensure that the processing of personal data carried out in this context complies with the law n ° 78-17 of January 6, 1978, relating to data processing, files and freedoms modified and the RGPD.

No consideration is provided by RAMPAL LATOUR in exchange for the filing of a Customer's review.

The maximum time limit for publication of a notice is 3 days. 

Finally, RAMPAL LATOUR sets up a free feature that allows any Customer to report a problem on a review, by sending an email to serviceclients@rampal-latour.fr

Thus, any Customer wishing to write to RAMPAL LATOUR about a particular review will be invited to write it at this address in serviceclients@rampal-latour.frproviding the precise references of the review concerned.

A posteriori, and in case of relevant report, RAMPAL LATOUR undertakes to delete a review only to the extent that it:

  1. Would not comply with these General Terms and Conditions of Sale;
  2. Contains offensive, defamatory, racist or unlawful content.

7. Delivery

7.1. Place of delivery

Rampal Latour delivers packages of Products in metropolitan France (Corsica and Monaco included), as well as in the countries of ZONE A. (Europe) and the OVERSEAS ZONE 1.

The Products will be sent to the delivery address that the Customer has indicated during the ordering process.

During the ordering process, RAMPAL LATOUR indicates to the Customer the possible shipping times and methods for the Products purchased.

Delivery costs are VAT included.

The Products will be packaged in accordance with the transport regulations in force in order to guarantee maximum protection for the Products during delivery.

 7.2. Products delivery time

The maximum delivery time for France (zone 1) is 4 (four) working days from the confirmation of the order.

The maximum delivery time for ZONE A countries is 5 working days from the confirmation of the order. 

These deadlines are from the moment you place your order before 12:00, for an item in stock, and provided you pay by credit card.

However, it is specified that these deadlines are given for information purposes only and cannot be binding vis-à-vis RAMPAL LATOUR.

7.3. Delivery methodes

LA POSTE: COLISSIMO WITHOUT SIGNATURE

Delivery costs depend on the weight of your package. The weight of the package may not exceed 30 kg.

The recipient can track his package through the parcel number he receives by email or, failing that, through Customer Service.

The parcel is delivered directly to the mailbox at the delivery address.

In the event that the mailbox is of insufficient size, the parcel is delivered either to the recipient of the order or failing that and at the initiative of La Poste to any other person present at the address who agrees to take delivery (a neighbor, or concierge). In this case, the contact details of the latter will be indicated on a notice delivered in the mailbox at the address indicated.

When the parcel could not be delivered in accordance with the procedures provided above, a notice of pending is left by La Poste in the recipient's mailbox indicating the contact details of the Post Office in which the recipient can collect the parcel within 14 days.

If the recipient does not collect his package within the time indicated by the postal services, it will return to our warehouse and the delivery costs will be charged to the Customer.

The Products will either be refunded or reshipped.

In the event of a dispute relating to the delivery itself, La Poste's computer system (flashing) shall prevail unless proven otherwise by the Customer.


LA POSTE: COLISSIMO WITH SIGNATURE

Delivery costs depend on the weight of your package. The weight of the package may not exceed 30 kg.

The recipient can track his package through the parcel number he receives by email or, failing that, through Customer Service.

The parcel must be delivered directly to the recipient or to any person present at the address indicated and able to sign the notice.

In case of absence, a notice will be deposited in his mailbox. The delivery person will try again the next day. If during the second passage, the person is still not present, the parcel will be collected at the nearest post office, (always against signature) within 14 days from the date written on the notice of passage.

If the recipient does not collect his parcel within the time indicated by the postal services, it will return to our warehouse and the delivery costs will be charged to the Customer. The Products will either be refunded or reshipped.

In the event of a dispute relating to the delivery itself, La Poste's computer system (flashing) shall prevail unless proven otherwise by the Customer.


RELAY POINTS

Delivery costs are free for any order equal to or greater than 69 € to metropolitan France, Belgium, and Luxembourg.

DPD Pickup for France.

Delivery costs depend on the weight of your parcel. The weight of the parcel may not exceed 20 kg. This rate applies to delivery in metropolitan France only (Corsica and Monaco included).

The recipient can track his parcel by the parcel number he receives by e-mail or, failing that, through Customer Service.

Once the parcel is prepared by us, it will be delivered to the relay within 48 hours, and the recipient receives notifications by SMS or e-mail. It must be collected within 10 working days.

If the recipient does not collect his package within the time indicated, it will return to our warehouse and the delivery costs will be charged to the Customer. The Products will either be refunded or reshipped.

In the event of a dispute relating to the delivery itself, DPD's computer system (flashing) shall prevail unless proven otherwise by the Customer.


COLISSIMO FOR EUROPE

Delivery costs depend on the weight of your parcel. The weight of the parcel may not exceed 20 kg. This rate applies to delivery in Zone A (Europe) only.

The recipient can track his parcel through the parcel number he receives by e-mail or, failing that, through Customer Service.

Once the parcel has been prepared by us, it will be delivered within an indicative period of 72 hours and the recipient will be informed by SMS and e-mail of its availability. It must then be collected within 10 working days.

If the recipient does not collect his parcel within the time indicated by the postal services, it will return to our warehouse and the delivery costs will be charged to the Customer. The Products will either be refunded or reshipped.

In the event of a dispute relating to the delivery itself, La Poste's computer system (flashing) shall prevail unless proven otherwise by the Customer.

7.4. Upon delivery

You must check the good condition of the goods delivered upon arrival of the parcel and before signing the receipt of the service provider in charge of delivery. If the delivered items are damaged or missing, you must refuse the package and note a reservation on the delivery note.

RAMPAL LATOUR is responsible until delivery of the Product to the Customer. It is recalled that the Customer has a period of three (3) days to notify the carrier of damage or partial losses noted during delivery. 

7.5. Late product deliveries

It is specified that deliveries are made within thirty (30) days maximum. Otherwise, the Customer must give formal notice to RAMPAL LATOUR to deliver within a reasonable time.

As such, the Customer may send an email to serviceclients@rampal-latour.fr or a registered letter with acknowledgment of receipt to the following address: RAMPAL LATOUR - Customer Services - 201 Impasse Gaspard Monge - 13300 Salon de Provence.

In case of non-delivery within this period, the Customer may terminate the contract.

No later than fourteen (14) days from the termination of these GTC, RAMPAL LATOUR will refund the Customer the total amount paid for the Products, taxes and delivery costs included, using the same payment method used by the Customer to purchase the Products.

8. Right of withdrawal

The terms of the right of withdrawal are provided for in the "withdrawal policy", policy available in Appendix 1 hereto.

9. Payment

9.1. Payment methodes

For purchases of Products on the www.rampal-latour.fr Site, the Customer may pay for his Products according to the means proposed by RAMPAL LATOUR, i.e.:

  • By credit card (secure payment and 3DS Secure). In case of single payment by credit card, the Customer's account will be debited as soon as the Products are ordered on the Site.
  • By the secure payment system PayPal whose general conditions are accessible at the following address: https://www.paypal.com/fr/webapps/mpp/ua/legalhub-full?locale.x=fr_FR
  • By Amazon Pay whose terms and conditions are available at the following address: https://pay.amazon.fr/help/201751590
  • By cheque payable to RAMPAL LATOUR. All cheques must be issued by a bank domiciled in metropolitan France and a copy of the identity document of the cheque issuer must be attached. In case of payment by check, the order of the Products is put on hold until its receipt and cashing upon receipt.

9.2. Security

We have no access to your confidential banking data at any time. Rampal Latour has chosen for payment security the online payment module offered either by PAYBOX or by HIPAY, based on the use of the SSL protocol which ensures the encrypted transmission of your personal information relating to the transaction.

Rampal Latour reserves the right to suspend or cancel any order and/or delivery in the event of non-payment by the Customer, payment incident and/or fraud in the use of the site or the means of payment chosen by the Customer.

9.3. Control

As part of the order control service, Rampal Latour may be required to contact the Customer by any means, with a view to validating a transaction and may, if necessary, request any supporting document deemed useful (relating to identity, and/or domicile and/or means of payment used). The Customer must provide the required supporting documents within 15 working days upon receipt of the request from Rampal Latour.

The Customer is informed that the delay, failure or refusal to transmit the requested supporting documents will result in the cancellation of the order by Rampal Latour.

Upon receipt of the supporting documents and in case of confirmation of the order by Rampal Latour, the transmission time of the parts requested by the Customer will postpone the delivery of the Product(s) ordered.

9.4. Late or refusal payment

If the bank refuses to debit a card or other means of payment, the Customer must contact RAMPAL LATOUR Customer Service to pay the order by any other valid means of payment.

In the event that, for any reason whatsoever, opposition, refusal or other, the transmission of the flow of money due by the Customer proves impossible, the order will be canceled, and the sale automatically terminated.

10. Evidence and archiving

Any contract concluded with the Customer corresponding to an order of an amount greater than euros 120 including VAT will be archived by RAMPAL LATOUR for a period of ten (10) years in accordance with Article L.213-1 of the Consumer Code.

RAMPAL LATOUR agrees to archive this information in order to monitor transactions and produce a copy of the contract at the request of the Customer.

In the event of a dispute, RAMPAL LATOUR will have the opportunity to prove that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.

11. Transfer of ownership

Rampal Latour reserves ownership of the Products delivered until full payment of the price.

These provisions do not prevent the transfer to the Customer, at the time of receipt by him or by a third party designated by him other than the carrier, of the risks of loss or damage to the Products subject to retention of title as well as the risks of damage that they may entail.

In these last two cases, Rampal Latour undertakes to provide a response within 2 working days (excluding delivery time of postal mail).

13. Guarantees

The consumer has a period of two (2) years from the delivery of the goods to claim for the legal guarantee of conformity in the event of the occurrence of a default of conformity, subject that such default existed at the time of the delivery. During this period, the consumer is only required to establish the existence of the default of conformity, but not the date of its occurrence (this period is of twelve (12) months for second-hand goods). The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty (30) days of his request, free of charge and without any major inconvenience to him. If the good is repaired within the framework of the legal guarantee of conformity, the consumer benefits from an extension of six (6) months of the initial guarantee. If the consumer requests the repair of the good, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two (2) years from the date of replacement of the good. The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract by being reimbursed in full and return the goods, if: 1 ° The professional refuses to repair or replace the good; 2 ° The repair or replacement of the of the goods occurs after a period of thirty (30) days; 3 ° The repair or replacement of the goods causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-conforming goods, or if he bears the costs of installing the repaired or replacement goods; 4 ° The non-conformity of the good persists despite the attempt to put in compliance of the seller remained unsuccessful. The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract where the lack of conformity is so serious that it justifies the immediate reduction in the price or termination of the contract. The consumer is then not obliged to request the repair or replacement of the goods beforehand. The consumer is not entitled to the cancellation of the sale if the lack of conformity is minor. Any period of immobilization of the good with a view to its repair or replacement suspends the guarantee that remained to run until the delivery of the restored asset. The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code. The seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of up to euros 300.000, which may be increased up to 10% of the average annual turnover (Article L. 241-5 of the French Consumer Code). The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two (2) years from the discovery of the defect. This guarantee gives right to a price reduction if the property is kept or to a full refund against return of the good.

In the event of non-conformity or hidden defect, the Customer is required to address his complaint to the Seller's customer service. In case of return of a product, the returned product must imperatively be accompanied by all its accessories, the purchase invoice, perfectly protected and, according to the instructions of the Seller, either sent by post, at the risk and peril of the Customer, to the address specified below in the standard withdrawal form.

The exercise of these guarantees takes place at no cost for the Customer, in accordance with Article L.217-11 of the French Consumer Code, provided, however, that the latter is entitled to claim the benefit of these guarantees.

14. Liability

Unless otherwise provided by mandatory law, RAMPAL LATOUR shall not be held responsible for indirect damage or damages of any kind resulting from the impossibility of placing an order or the unavailability of an ordered Product.

The responsibility of RAMPAL LATOUR shall in no event be held in stake for failure to perform or for poor performance of the contractual obligations by the Customer, in particular when placing an order.

RAMPAL LATOUR shall not be held liable, or considered as having failed herein, for any delay or non-performance, when the cause of the delay or non-performance is related to a case of force majeure as defined below.

It is also specified that RAMPAL LATOUR does not control websites that are directly or indirectly linked to the Site. Consequently, it excludes any liability for the information published therein. Links to third-party websites are provided for information purposes only and no guarantee is provided as to their content.

15. Force majeure

RAMPAL LATOUR cannot be held liable if the non-performance or delay in the performance of one of its obligations described in these GTC results from a case of force majeure.

Force majeure exists in contractual matters when an event beyond the control of the debtor, which could not reasonably have been foreseen at the time of the conclusion of the contract and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing its obligation. In addition, the parties acknowledge that the following events will automatically be assimilated to cases of force majeure as soon as they are reasonably beyond the control of RAMPAL LATOUR and despite the fact that they do not meet all the conditions required by the case law: strikes (announced or not) affecting the performance, by RAMPAL LATOUR and / or its own suppliers, of their contractual obligations, the contractual non-performance by RAMPAL LATOUR resulting from its suppliers (late delivery of the supplier ...) or its carriers (delay, loss of the goods ...), the lockout, the difficult weather conditions (frost, bad weather ...) as well as any event beyond the control of RAMPAL LATOUR which makes impossible or calls into question the financial balance existing on the day of placing the order.

If the impediment is temporary, performance of the obligation shall be suspended unless the resulting delay justifies termination of the contract. If the impediment is definitive, the contract is terminated ipso jure and the parties are released from their obligations under the conditions provided for in Articles 1351 and 1351-1 of the Civil Code.

As such, RAMPAL LATOUR cannot be held liable in particular in the event of an attack by hackers, unavailability of equipment, supplies, spare parts, personal or other equipment, interruption of electronic communications networks, as well as in the event of the occurrence of any circumstance or event beyond the control of RAMPAL LATOUR occurring after the conclusion of the GTC and preventing execution under normal conditions. 

It is specified that, in such a situation, the Customer may not claim the payment of any compensation and may not bring any recourse against RAMPAL LATOUR. 

In the event of one of the aforementioned events, RAMPAL LATOUR will endeavor to inform the Customer as soon as possible.

16. Personal data

RAMPAL LATOUR collects on the Site personal data concerning its Customers, including by means of cookies. Customers can deactivate cookies by following the instructions provided by their browser.

The data collected by RAMPAL LATOUR is used to process orders placed on the Site, manage the Customer's account, analyze orders and, if the Customer has expressly chosen this option, send prospecting letters, newsletters, promotional offers and / or information on special sales, unless the Customer no longer wishes to receive such communications from RAMPAL LATOUR.

The Customer's data are kept confidential by RAMPAL LATOUR for the purposes of the contract, its performance and in compliance with the law, for a period of 3 years from the end of the commercial relationship if you are a customer or from your last contact if you are not yet a customer.

Customers may unsubscribe at any time by accessing their account or by clicking on the hypertext link provided for this purpose at the bottom of each offer received by email.

The data may be communicated, in whole or in part, to RAMPAL LATOUR's service providers involved in the ordering process. For commercial purposes, RAMPAL LATOUR may transfer to its commercial partners the names and contact details of its Customers, provided that the latter have expressly given their prior consent when registering on the Site.

RAMPAL LATOUR will specifically ask Customers if they wish their personal data to be disclosed. Customers may change their mind at any time by contacting RAMPAL LATOUR. RAMPAL LATOUR may also ask its CUSTOMERS if they wish to receive commercial solicitations from its partners.

In accordance with Law No. 78-17 of 6 January 1978 relating to data processing, files and freedoms and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data,  and repealing Directive 95/46/EC (General Data Protection Regulation known as GDPR), RAMPAL LATOUR ensures the implementation of the rights of the persons concerned.

It is recalled that the Customer whose personal data is processed has the right to access, rectify, update, port and delete information concerning him, as well as a right to limit processing in accordance with Articles 49, 50, 51, 53 and 55 of the French Data Protection Act (Loi Informatique et Libertés) and the provisions of Articles 15, 16, 17 and 18 of the European General Regulation on the Protection of Persons (GDPR).

In accordance with the provisions of Article 56 of the Data Protection Act and Article 21 of the GDPR, the Customer may also, for legitimate reasons, oppose the processing of data concerning him, without reason and free of charge. 

The Customer may also define the fate of his data after his death and choose whether or not RAMPAL LATOUR communicates his data to a third party that the Customer has previously designated.

The Customer may exercise these rights by sending an email to: serviceclients@rampal-latour.fr or by sending a letter to Rampal Latour - CUSTOMER SERVICE - Zac de la Crau 201 impasse Gaspard Monge - 13300 SALON DE PROVENCE.

Finally, the Customer may also lodge a complaint with the supervisory authorities and in particular the CNIL (https://www.cnil.fr/fr/plaintes).

17. Modification of these Terms and Conditions of Sale

Rampal Latour reserves the right to modify at any time the content or characteristics of these General Conditions of Sale. Each order gives rise to the acceptance of the General Conditions of Sale in their version in force.

The applicable General Terms and Conditions of Sale are those in force at the time of the order. Changes to the GTC will not apply to Products already purchased.

18. Validity of the terms and conditions

If one or more stipulations of these General Terms and Conditions of Sale are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

Such a modification or decision does not in any way authorize Customers to disregard these General Terms and Conditions of Sale.

19. Intellectual Property

SARL Rampal Patou is the owner of all intellectual and industrial property rights relating to the Internet Site and the Rampal Latour brands or holds the rights of use relating thereto.

Access to this internet Site does not confer any right on the intellectual property rights relating to the Site which remain the exclusive property of SARL Rampal Patou.

The general structure of the Site, but also the elements accessible on the Site, in particular in the form of texts, photographs, images animated or not, icons, maps, sounds, videos, software, database, data and all other elements composing the Site are the exclusive property of SARL Rampal Patou. You may not, under any circumstances, reproduce, represent, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written permission of SARL Rampal Patou. You are informed that this prohibition applies in particular, but not exclusively, to practices such as scrapping or the use of robots for the purpose of extracting, reproducing any element of the Site, including the offers of Products presented therein, in particular for commercial purposes.

You may not frame or use framing techniques to insert any trademark, logo or any other information (including images, text, layout or shape) of Rampal Latour without its prior written and express consent. You are not authorized to use meta tags or any other "hidden text" using the name or trademarks registered within Rampal-Patou without the prior written and express consent of SARL Rampal Patou.The exploitation not previously authorized by SARL Rampal Patou for any reason whatsoever, of all or part of the Site, may be subject to any appropriate action,  in particular, an action for infringement.

The insertion of hypertext links to any part of the Site is prohibited without the prior written permission of SARL Rampal Patou.

Any representation or reproduction, total or partial, of the Site and its contents, by any process whatsoever, without the express prior authorization of RAMPAL LATOUR, is prohibited and will constitute an infringement punishable by Articles L.335-2 and following and Articles L.713-1 and following of the Intellectual Property Code.

The acceptance of these GTC implies recognition by the Customer of the intellectual property rights of RAMPAL LATOUR.

20. Jurisdiction and applicable law

These General Terms and Conditions of Sale as well as the relations between the CUSTOMER and RAMPAL LATOUR are governed by French law.

In case of dispute, only the French courts will be competent.

However, prior to any recourse to the judge, the Customer is invited to contact the complaint department of RAMPAL LATOUR.

If no agreement is reached or if the Customer justifies having attempted, beforehand, to resolve his dispute directly with RAMPAL LATOUR by a written complaint, it will then be proposed an optional mediation procedure, conducted in a spirit of loyalty and good faith with a view to reaching an amicable agreement when any conflict relating to this contract arises, including its validity.

To initiate this mediation, the Customer may contact the mediator of RAMPAL LATOUR: online mediation service of the CMAP (Centre de médiation et d'arbitrage de Paris), whose contact details are: CMAP (Service Médiation de la Consommation) - 39 avenue Franklin D. Roosevelt - 75008 Paris, and which can be entered via this link: http://www.cmap.fr/

For the referral to the CMAP to be admissible, it must include: your mail, email and telephone details as well as the full name and address of our company, a brief statement of the facts, and proof of the preliminary steps taken.

In accordance with the rules applicable to mediation, it is recalled that a consumer dispute must be entrusted in advance in writing to RAMPAL LATOUR Customer Service before any request for mediation with the CMAP.

The party wishing to implement the mediation process must first inform the other party by registered letter with acknowledgment of receipt indicating the elements of the conflict.

As mediation is not mandatory, the Client or RAMPAL LATOUR may withdraw from the process at any time.

In the event that mediation fails or is not envisaged, the dispute that may have given rise to mediation will be entrusted to the competent court designated above.

Appendix 1 - Withdrawal policy

Principle of withdrawal

The Customer has, in principle, the right to withdraw by returning the Product to RAMPAL LATOUR without giving any reason.

To do so, the Product must be sent back or returned no later than fourteen (14) days following the communication of its decision to withdraw, unless RAMPAL LATOUR offers to recover the Product itself.

Withdrawal period

The withdrawal period expires fourteen (14) days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the goods.

In the event that the Customer has ordered several Products via a single order giving rise to several deliveries (or in the case of an order of a single Product delivered in several lots or pieces), the withdrawal period will expire fourteen (14) days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good or lot or the last piece. In the case of an order for the regular delivery of goods for a specified period, this period expires on the day on which the first good is taken over.

The day on which the order is concluded or the day of receipt of the goods is not counted in this period. If this period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the next working day.

Notification of the right of withdrawal

To exercise his right of withdrawal and in accordance with Article L.221-21 of the Consumer Code, the Customer must notify his decision to withdraw by means of an unambiguous declaration (for example, letter sent by post, fax or email) to: serviceclients@rampal-latour.fr or 201 Impasse Gaspard Monge - 13300 Salon de Provence.

In order for the withdrawal period to be respected, the Customer must send his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.


Effects of withdrawal

In the event of withdrawal by the Customer, RAMPAL LATOUR undertakes to refund all sums paid, including delivery costs (with the exception of additional costs arising, where applicable, from the Customer's choice of a delivery method other than the standard delivery method offered by RAMPAL LATOUR) without undue delay and no later than 14 days from the day on which RAMPAL LATOUR was informed of the Customer's decision to withdraw. (Article L.221-24 of the French Consumer Code)

Unless it offers to collect the Products itself, RAMPAL LATOUR may defer the refund until recovery of the Products or until the Customer has provided proof of shipment of the Products, the date to take in account being that of the first of these facts.

RAMPAL LATOUR will proceed with the refund using the same means of payment that the Customer used for the initial transaction, unless the Customer expressly agrees to use another means of payment and insofar as the refund will not incur any costs for the Customer.

Return policy

The Customer must in any case, no later than fourteen (14) days after the communication of his decision to withdraw from this contract, return the goods to: 201 Impasse Gaspard Monge - 13300 Salon de Provence.

This period is deemed to have been respected if the CUSTOMER returns the goods before the fourteen (14) day period has expired.

Return costs

The Customer must bear the direct costs of returning the good.

In the event that the weight of the Product prevents the Customer from returning the Product by post, the Customer must bear the direct costs of returning the good.

Condition of the returned goof

The Product must be returned according to the instructions of RAMPAL LATOUR and include all the accessories delivered. Any promotional gifts sent with the order must also be returned.

The Customer is only liable for the depreciation of the goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the Product. In other words, the Customer may test the Product but may be held liable if it is handled in a matter other than that required.

Exclusions from the right of withdrawal

The right of withdrawal is excluded for contracts listed in Articles L. 221-2 and L. 221-28 of the French Consumer Code, in particular under the following circumstances:

  • Supply of services fully performed before the end of the withdrawal period and where performance has begun after prior express agreement of the consumer and express waiver of his right of withdrawal;
  • Supply of goods or services whose price depends on fluctuations in the financial market
  • Supply of goods fashioned according to the CUSTOMER's specifications or clearly personalized
  • Supply of goods likely to deteriorate or expire rapidly
  • Supply of sealed audio or video recordings or software that have been unsealed after delivery
  • Newspaper, periodical, magazine (except subscription contract)
  • Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities if the offer provides for a specific date or period of performance
  • Supply of goods which by their nature are inseparably mixed with other items
  • Supply of sealed goods that cannot be returned for reasons of health protection or hygiene and that have been unsealed by the CUSTOMER after DELIVERY
  • the supply of alcoholic beverages whose price was agreed at the time of conclusion of the sales contract, the delivery of which can only be made after 30 days and whose actual value depends on fluctuations in the market beyond the control of the SELLER
  • Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him/her, within the limits of spare parts and work strictly necessary to respond to the emergency;
